Sixty Plus Program - Deed Changes

Simple deed changes can be drafted if the transaction is within your family, and no money changes hands. This may happen when one spouse moves to nursing home and wants to place the title to the couple's house solely in the name of the spouse still living there.

The Sixty Plus Program can also help you if NO MONEY is changing hands - if the house (or land) is NOT being sold but you just want to

  • update the deed or
  • correct what the deeds says or
  • you want to give the house to a family member.

However, be careful about transferring the deed to your property to someone else for less than fair market value. You might have tax penalties. You could become ineligible for Medicaid nursing home coverage. You should talk to a lawyer about what your goal is before you change your deed.

The Sixty Plus Program cannot help you if anyone else's name is on the deed, unless

  • that person also agrees and signs a transfer OR
  • the other owner is dead and whoever inherited the property agrees to sign a transfer.
