Disciplinary Rules For Special Education Students
If a child is a special education student, there are separate regulations by the Maryland Department of Education for disciplinary rules. School discipline generally is in the "discipline" section of the Peoples Law Library. The rules for special education students are located in the Code of Maryland Agency Regulations (COMAR) at 13A.08.03 (click on "Discipline of Students with Disabilities" to see the full list of regulations in this chapter. If your child is involved in a disciplinary procedure at school, is not in special education, but you have reason to suspect your child may have a disability, you should look at our list of questions. These questions give you a basis to decide whether you should ask for your child to be evaluated before the disciplinary action. Some key regulations on discipline of children with disabilities are:
