More Details on the Montgomery County Trans
Fat Ordinance and Assisted Living Facilities (ALFs)
The wording of the 2007 ordinance does not specifically mention ALFs.
Instead the ordinance covers “eating and drinking establishments”. In
September of 2007, we asked the Montgomery County Department of Health
and Human Services, Licensure and Regulatory Services to clarify the
legal authority for inclusion of assisted living facilities under this
new ordinance.
- ALFs with 17 or more residents -
A spokesperson for the Department said that 'eating and drinking
establishments' includes all businesses that are required to have a food
service license under
COMAR
10.15.03.12. ALFs with 17 or more residents are required by
COMAR
10.07.14.38 F (2) and (3) to have a food service license. Therefore,
this new ordinance covers assisted living facilities housing 17 or more
residents.
- ALFs with 16 or fewer residents –
Montgomery County facilities that have fewer residents are not required
to follow this new ordinance. However, it may make sense to do so for
the benefit of the residents.
