Special Landlord-Tenant Laws and Rules for Anne Arundel County and Annapolis

The following laws and rules apply only to residents and property in Anne Arundel County. The following does not apply to any other areas of Maryland.  Remember that the rules not covered here are covered by other Maryland law to explore State law regarding your legal problem.  Make sure you explore both local and state law.

(HB 452) Entitled: Landlord and Tenant – Summary Ejectment – Deceased Tenant

This bill permits a landlord to bring an action for summary ejectment against a tenant under lease who has died without a will and without next of kin.  (effective 10/1/08)

The Legal Aid Bureau is a non-profit agency that offers legal services to people whose income is below a  certain level.  Legal Aid handles a variety of civil cases (divorce, custody, welfare, consumer affairs, landlord-tenant cases, etc.) but it does not handle criminal cases or fee-generating cases such as personal injury. Clients are seen by appointment.

For modest fees for filing and service of process, any person 18 years of age or older may file a Small 

Claims suit for up to $2,500.  The form provided by the court is easy to fill out.  Be sure to bring to court the records of the transaction involved, such as receipts, leases, letters, etc.

For a slightly higher filing fee, a complaint may be filed for up to $20,000 in District Court.

The Division enforces the Maryland Consumer Protection Law and answers questions concerning security deposits, rent escrow and evictions.  Its methods are primarily mediation and arbitration.

ANNE ARUNDEL COUNTY LAWS

HOUSING MAINTENANCE AND OCCUPANCY CODE 
The purpose of the Housing Code is to promote the physical, mental, and social well-being of the people by safeguarding the quality of all housing, whether privately owned or publicly owned.  The Code provides the following:  minimum standards for light, ventilation, and heat; safeguards against fire; space requirements for human occupancy; standards for maintenance; specific responsibilities of owners, operators, and occupants; and administration and enforcement.  

CITY OF ANNAPOLIS LAWS

ANNAPOLIS RESIDENTIAL HOUSING CODE (Annapolis City Code, Chapter 17.40)
The Housing Code provides minimum standards for kitchen and toilet facilities, hot water, heating, ventilation, lighting, fire safety, use of space, maintenance, etc., for all dwellings, whether owner-occupied or tenant-occupied.  It outlines the responsibilities of landlords and tenants and the procedures for inspection and enforcement, and provides for licensing of all rental dwelling units, multiple dwellings and rooming houses.  Sections 17.40.670-17.40.700 contain provisions applicable to rooming houses.
