Responsibilities of Owners (Baltimore City)

Noncompliance with Code; prohibited leases and subleases
An owner may not lease or permit a sublease for a vacant or vacated dwelling unit which does not comply with the requirements of this Code, unless the Commissioner of Housing and Community Development has granted permission.

Sanitary maintenance
In a dwelling containing 2 or more units, the owner is responsible for keeping the shared or public areas clean.

Garbage, rubbish, and ashes
In a building with 3 or more units, the owner must provide in an accessible location an adequate number of receptacles for storage of garbage, rubbish, and ashes between collection days. The receptacles must be metal, watertight, and provided with handles and tight covers. Garbage chutes are permitted only to an approved incinerator.
 

Heat
Where the heating facilities are not controlled by the occupant, the owner, agent, or operator must, from October 1 to May 1, maintain an average temperature of 70°F. in all habitable rooms, bathrooms, and toilet rooms, with no temperature going below 65°F. However, during October 1 - May 1, from 12 midnight to 5 a.m. each day, the temperatures of 70°F. and 65°F. may each be reduced by a maximum of 5 degrees.

Rat proofing and pest extermination
Where infestation occurs in the shared or public areas or in 2 or more dwelling units in a building, the owner is responsible for extermination of rats, insects, or other pests.

All dwellings and dwelling units must be rat-proofed and kept in a rat-proof condition by the owner. Rat proofing includes but is not limited to: 1) using rat impervious material to block all passages by which rats could enter from outside; and 2) paving basements, cellars, and other areas in contact with the earth; eliminating rat breeding places by keeping areas clean; removing rats' nests, etc.

Display of multiple dwelling license
The person to whom the license is issued must display it in the lobby or other prominent or public place on the premises during the period when it is in effect.

Posting information about owner or agent
In a multiple-family dwelling in which the owner does not live, the name, address, and telephone number of the owner, agent, or other responsible person must be posted in a public or prominent place. This information must be accurate and up-to-date. A post office box number is not an adequate address. In single-family and two-family dwellings in which the owner does not live, the required information may be either posted or given in writing to the occupants.

Posting information about utility services
In a multiple-family dwelling in which the owner does not live, he must keep posted in a prominent place the name, address, and telephone number of the person to call in case of failure or impairment of a utility service. This information must be kept up-to-date.

Cleanliness of sidewalks, alleys, and gutters
The owner must not deposit garbage or rubbish into the street, gutters or alleys abutting the property. The owner or operator of a dwelling containing 2 or more dwelling units must keep the abutting sidewalk, gutter, and adjoining half of the alley clean and free of garbage, rubbish, bulk trash, etc.

Notice of exits
The owner, operator, or agent must notify the occupants of the passage to all required exits, except in a hotel or motel where a floor plan is posted in each room. Where an exit is through a glass panel door, the owner, operator, or agent must actually go with the tenant through the passage to the exit.

Tenant's vandalism or neglect of the property
Even if tenant commits or permits vandalism or fails to protect the water pipes in freezing temperatures, the owner must still fulfill his duties and responsibilities under this Code.
