Who is covered?

Residents who own their mobile homes and rent or lease a site for residential use from a Park Owner and reside in a Mobile Home Park. 

Tenants who rent a mobile home or a fixed dwelling from landlord who owns the land or property.

Leases

Mobile Home Park Owners must provide qualified residents with a minimum lease term of not less than 1 year. MD Annotated Code – Real Property Art. 8A, 8A-202 (a)
1- year lease term must be provided to qualified residents, unless residents request month to month lease term prior to beginning of new lease t
erm.

Landlords are allowed to provide tenants with a 1 year or month to month lease term.

Increase in Rent

Park Owners can only increase park fee, if notice of increase is provided to each resident in writing, at least, 30 days before effective date of increase. MD Annotated Code – Real Property Art. 8A, 8A-401 (a)

Landlords must provide tenants notice of rent increase in writing, at least, 30 days before effective date of increase.

Late Fees

Park Owners may charge a late fee, if the fee does not exceed 5% of the rent due or $5, whichever is higher. MD Annotated Code – Real Property Art. 8A, 8A-404 (2)

Security Deposits

Park Owners cannot impose a security deposit in excess of the equivalent of 2 months’ rent or $50 MD Annotated Code – Real Property Art. 8A, Section 8A-1001 (a)

Evictions

Park Owners may only evict resident for non-payment of rent and violations of lease. MD Annotated Code – Real Property Art. 8A, Section 8A-1101 (a) (1) (2).

Landlords may terminate lease agreements for non-payment of rent. MD Annotated Code – Real Property Art. 8A, 8-401 (a) (b)

Non-Payment of Rent

Requires District Court Complaint for Repossession of Premises. MD Annotated Code – Real Property Art. 8A, 8A-1701 (b)

Requires filing of District Court Complaint for Repossession of Premises. MD Annotated Code – Real Property Art. 8A, 8-401 (b)

Appeals

Park Owners must wait 15 days before filing Warrant of Restitution. MD Annotated Code – Real Property Art. 8A, 8A-1701 (d)

Landlords must wait 4 days before filing Warrant of Restitution. MD Annotated Code – Real Property Art. 8A, 8-401 (d)

Notice to Quit

Park Owners must give qualified residents 30-day written notice to end lease term MD Annotated Code – Real Property Art. 8A, 8A-1702 (b)

Landlords must provide tenants with a 30-day notice prior to expiration of lease term. MD Annotated Code – Real Property Art. 8A, 8-402(b)
