Insurance Appeals Information
Either an applicant for benefits or an employer can appeal Unemployment Insurance decisions. The first level of appeal is to ask for a hearing before a Hearings Examiner. The appeal must be received in writing by the Unemployment Office within 15 days of the date on the decision. The claimant or employer has a right to file a further appeal or may petition for further review, to the three-member Board of Appeals. The Board is empowered to either review the hearing examiner's decision on the record or to hold an additional hearing. The Maryland Unemployment Decisions Digest contains summaries of precedent decisions on the sections of the law most used by hearing examiners. The digest is a valuable tool for those building an unemployment insurance case. The Board's written decision is appealable to the Circuit Court, but the Court's review is limited to the record. |
